The contract comes bindingly and irrevocably into effect in accordance with § 156 BGB (German Civil Code) upon notarisation.
The bid of the highest bidding person is accepted. The highest bidder is requested to provide identification after acceptance. If the bidder represents a third party or a company, it is compulsory that this is verified by means of a respective certificate of authority (and certificate of registration where applicable). If no certificate of authority can be provided, the person who held up a hand as the highest bidder (buyer) is included in the contract.
A later change
can only be performed upon further notarisation and is, at any event, subject
to further costs.
Witnessed by
the present notary, the auctioneer signs the auction record while still in the
auction room. The second part of the record (necessary for the processing) is
notarised a little later with the assistance of the highest bidder and in the
privacy of a separate room. An

Fiscal identification particulars
Due to the amendment (§ 20 GrEStG - Real Estate Transfer Tax Act),
which came into effect on the 14 of December 2010, notaries are now obligated
to state the tax identification number, in accordance with § 139 b of the general tax code or the economic identification number in
accordance with § 139 c of the general tax code of
the vendor and the highest bidder, when applying for the tax clearance
certificate.
Therefore, we
kindly ask you to provide us with these details (or, alternatively, your tax number
from the last tax return) on the day of the auction.
Real estate transfer tax
The real estate transfer tax, which is obtained bids from € 2.500, is in Mecklenburg-Vorpommern and Schleswig-Holstein each 3.5% of highest bid.
Personal attendance
You are provided with advantages if you submit a written bid before the
auction takes place.

limit for submitting the highest bid is extended to up to 2 months*
- the payment of the bidding security is not applied. Thus, you retain
liquidity.
If you want to
benefit from these advantages, please fill in the
minimum bid (PDF 82 kB), printed on page 3 in the
online catalogue, and then send/fax the signed bid to the auction house. After
performing a credit-worthiness check (bank account statement/statement of
deposited securities etc. will suffice), we will confirm to you the acceptance
of the bid with a counter-signature.
Bidding via telephone
Auction participation via telephone is possible, provided that a telephone line is available. Therefore, we recommend that you contact the auction house at the earliest possible date. We will then draw up the necessary written agreement and have it sent to you. You can even enjoy the advantages mentioned above when bidding via telephone. The auction house will not charge you any fees for this additional service. However, higher costs will be incurred for the notarial processing. Due to the fact that you cannot attend the notarisation personally in this case, a notarial confirmation of power of authority is subsequently required for notarisation. This confirmation of power of authority is associated with expenses charged in compliance with the Cost Regulation Order for Notaries.
Viewing
The auction house would like to point out that any access to the properties, whether motorised or pedestrian, is performed at one's own risk and is only permitted upon prior approval by the owner.
